Compliance is the part of HR that stays invisible until it isn\u2019t. A growth company can operate for years without a formal framework \u2014 right up until a complaint, an inspection or a due-diligence process turns a quiet gap into an urgent liability.

The good news: the core obligations are well-defined. Here is the practical spine every scaling Indian company should have in place.

POSH: not optional, not paperwork

The Prevention of Sexual Harassment Act applies to any workplace with ten or more employees. Compliance means a written policy, a properly constituted Internal Committee with the required external member, documented awareness sessions, and an annual report filed with the district officer.

Most companies have the policy PDF and little else. A functioning POSH framework is a live process, not a document \u2014 and the difference becomes stark the first time it is tested.

Provident Fund and ESIC

Provident Fund registration becomes mandatory at twenty employees, with monthly contributions and filings that must reconcile precisely. Employees\u2019 State Insurance applies to eligible employees below the wage threshold. Both are unforgiving of late or inaccurate filings, and both compound quietly when payroll scales faster than process.

Shops & Establishments and state-level obligations

Registration under the relevant state\u2019s Shops & Establishments Act governs working hours, leave, and conditions of employment \u2014 and varies by state, which trips up companies operating across multiple locations.

The pattern behind every gap

Each of these obligations is manageable in isolation. They become a problem for the same reason: no one owns them. Hiring gets a recruiter; compliance gets deferred to “later.” A dedicated HR function closes that gap by treating compliance as proactive infrastructure \u2014 handled before it becomes a question, audit-ready before anyone asks.

That is the quiet value of embedded HR leadership: the risks that keep founders awake simply stop being their problem to track.
